Upgel/Bike maintenance

Terms of Service

Last updated

Please read these terms before using Upgel Bike Maintenance. They set out what our guides are, what they are not, and the limits of what we can be responsible for.

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the website at https://upgel.online and all its pages and features (together, the "Site"), operated by Upgel ("Upgel", "we", "us" or "our"). By accessing or using the Site you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.

If you are using the Site on behalf of an organisation, you confirm you are authorised to accept these Terms on its behalf.

2. Safety — the most important section here

By using the Site you acknowledge and agree that:

  1. You are responsible for deciding whether a repair is within your competence, and for stopping and consulting a professional mechanic if it is not.
  2. Your bicycle's manufacturer instructions, torque specifications and service limits always take precedence over anything written here. Where they conflict with our guides, follow the manufacturer.
  3. You will inspect and test your own work before riding, and you will test brakes and steering at low speed in a safe place first.
  4. Some components — including carbon fibre parts, hydraulic brake systems, suspension internals, and anything held by a torque specification you cannot measure — may require tools, training or equipment you do not have.
  5. You use the information on this Site entirely at your own risk.

Nothing on this Site is professional, engineering, legal or safety advice. See our full Disclaimer for more.

3. Definitions

  • Content means all text, guides, illustrations, diagrams, figures, tables, metadata and other material available on the Site.
  • You or User means any person who accesses or uses the Site.
  • Third-Party Services means services operated by others, including any advertising, analytics and linked websites.

4. Eligibility

The Site is intended for a general audience. If you are a minor in your jurisdiction (generally under 18), use the Site only with the involvement of a parent or guardian. By using the Site you confirm that you can form a binding contract and are not barred from doing so under applicable law.

5. Intellectual property

All Content on this Site is original work created by Upgel, except where a source is explicitly cited. The Site design, layout, branding, original diagrams and figures, and the text of every guide are our property or licensed to us, and are protected by copyright and other intellectual property laws. The "Upgel" name and logo are our trademarks and may not be used without permission.

What you may do

  • Read, print and save our guides for your own personal, non-commercial use, including printing a guide to take into your garage.
  • Quote short extracts with clear attribution and a link back to the original page.
  • Link to any page on the Site freely. You do not need our permission to do that.

What you may not do

  • Republish, syndicate or mirror our guides, in whole or in substantial part, on another site or in another publication.
  • Use our Content to train, fine-tune or ground a machine learning model or dataset without our written permission.
  • Systematically scrape, crawl or bulk-download the Site, or use automated tools that place unreasonable load on our infrastructure.
  • Remove or alter any copyright, trademark or attribution notice.
  • Present our Content as your own, or use it in a way that implies we endorse you or your product.

6. Acceptable use

You agree not to use the Site in violation of any applicable law; to interfere with, disrupt or attempt to gain unauthorised access to the Site or its servers; to distribute malware or engage in fraudulent, harmful or deceptive activity through it; or to misrepresent material as your own when submitting anything to us.

7. Accuracy of content

We research our guides carefully and cite sources so you can check our work. Even so, specifications change, manufacturers revise their instructions, and errors happen. We do not warrant that any guide is complete, current or correct for your particular bicycle.

If you find an error — a wrong torque figure, an outdated specification, a step in the wrong order — please tell us at contact@upgel.online. We take corrections seriously and we would rather hear about a mistake than leave it in front of the next reader.

8. Your submissions

If you send us a correction, suggestion, comment or other material, you confirm you have the right to send it, and you grant us a non-exclusive, worldwide, royalty-free licence to use, edit and publish it on the Site. We may review, decline, edit or remove any submission at our discretion. We are not obliged to keep submissions confidential or to compensate you for them.

9. Third-party links

Our guides cite and link to external sources, including manufacturer documentation, standards bodies and published research. We do not control those sites and are not responsible for their content, policies or practices. Links are provided so you can verify our sources and do not imply endorsement.

10. Advertising

The Site is supported by advertising, including Google AdSense. Third-party vendors, including Google, use cookies to serve ads based on your prior visits to this and other websites. You can opt out of personalised advertising at My Ad Center or through the Digital Advertising Alliance. Where the law requires it, we ask for your consent before advertising cookies are set.

We do not control and are not responsible for the content of advertisements, or for the products and services they promote. Any dealings with an advertiser are solely between you and them. Advertising is kept visually distinct from our guides, and no advertiser has any influence over what our guides say.

11. Cookies and analytics

The Site uses cookies and similar technologies. Full detail, including how to control each category, is in our Cookie Policy and Privacy Policy.

12. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure or error-free, or that any guide is accurate or suitable for your bicycle. Nothing on the Site is professional advice.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UPGEL AND ITS OWNERS, OPERATORS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY.

Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100.00).

14. Indemnification

You agree to indemnify and hold harmless Upgel and its owners and operators from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or your infringement of any law or third-party right.

15. Copyright complaints

We respect intellectual property rights and respond to notices of alleged infringement under the US Digital Millennium Copyright Act. The full notice and counter-notice procedure, including everything a valid notice must contain, is set out on our DMCA & Copyright Policy page.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved in the courts having competent jurisdiction there, and you consent to the jurisdiction of those courts, except where applicable law prohibits it or gives you a right to bring proceedings elsewhere.

17. International users

The Site is operated from the United States. We make no representation that the Content is appropriate or available in other locations. If you access the Site from elsewhere you do so on your own initiative and are responsible for compliance with local law, including any local standards or regulations governing bicycle equipment and roadworthiness.

18. Changes to these Terms

We may update these Terms at any time. When we do we will revise the "Last updated" date above, and material changes may be highlighted on the Site. Continuing to use the Site after changes are posted means you accept the revised Terms.

19. Termination

We may suspend or restrict access to the Site, in whole or in part, at any time and for any reason, including breach of these Terms. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnification and governing law — survive termination.

20. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Site.
